Srbija treba da u javnoj upravi unapredi razumevanje i
uvažavanje uloge nezavisnih tela, uključujući Zaštitnika građana, a Skupština
Srbije da bude aktivnija u nadzoru izvršne vlasti, ocenila je Evropska komisija
u godišnjem izveštaju o napretku Srbije na putu ka EU. U izveštaju koji je
objavljen 9. novembra, ističe se da je važno da se "adekvatno odgovori na
sve preporuke" nezavisnih tela a "posebno u vezi sa pitanjima koje su
od značaja za javnost". Ukazuje se da, kada je reč o pristupu informacijama
od javnog značaja, problem predstavlja "ćutanje administracije".
"Praksu redovnih sastanaka sa premijerom koja je za
pohvalu, treba dalje nadograditi u cilju poboljšanja shvatanja i uvažavanja u
državnoj upravi osnovne uloge kancelarije Zaštitnika građana i drugih
nezavisnih vlasti i regulatornih tela da osiguraju da izvršna vlast bude
odgovorna", navodi se u izveštaju.
Ocenjuje se da je Skupština Srbije uložila napore da bude
otvorenija i da unapredi konsultativni proces, ali da se često pribegava hitnim
procedurama u donošenju zakona, a dnevni red parlamenta menja u poslednjem
trenutku.
Takođe, parlament pruža "ograničenu podršku"
nezavisnim regulatornim telima i nije dovoljno aktivan u nadzoru izvršne
vlasti, dok prave stranačke debate nema, što sve umanjuje efikasnost
parlamenta, navodi se u izveštaju.
U delu koji se odnosi na civilni nadzor nad službama
bezbednosti traži se veće razumevanje i zalaganje za ulogu Zaštitnika građana
na tom polju i aktivnija uloga parlamenta.
Dodaje se da treba dalje postupati po preporukama
Ombudsmana u vezi sa neleglanim prikupljenjam podataka Vojnobezbednosne
agencije (VOA) o aktivnositma političkih stranka. Zaštitnik građana Saša
Janković je početkom prošle godine izneo sumnju da VOA bez odluke suda
prikuplja podatke o političkim strankama, liderima sindikata i pojedinim
sudijama.
Evropska komisija je navela da se mora rešavati pitanje
mogućnost zloupotrebe presretnutne komunkacije.
Konstatuje se da se skupštinski Odbor za kontrolu službi
bezbednosti povremeno sastajao kako bi razmotri aktivnosti
Bezbednosno-informativne agencije, VOA i Generlanog inspektorata Ministarstva
odbrane.
U izveštaju se navodi da pravo na pristup informacijama
od javnog značaja regulisano zakonom koji nije u potpunosti usklađen sa
evropskim standardima.
Ćutanje administracije
"Ćutanje administracije je važno pitanje, kao što je
na to ukazao Poverenik za pristup informacijama od javnog značaja koji nadgleda
primenu zakona", navodi se u izveštaju.
Ističe se i da se mora hitno doneti novi zakon o zaštiti
podataka o ličnosti u skladu sa standardima EU.
Komisija je konstatovala da nisu adekvatno regulisani
obrada i zaštita osetljivih ličnih podataka, biometrijskih podataka i video
nadzora, zaštita podataka na internetu i direktni marketing, što, kako se
dodaje, ostavlja prostor za zloupotrebe.
Evropska komisija je ocenila da treba pojačati kapacitete
i resurse Kancelarija povernika za informacije od javnog značaja, i zakon
poboljšati kako bi se njegove preporuke primenjivale.
Kada je reč o prevenciji torture i lošeg postupanja
podseća se da Kancelarija ombudsmana ujedno predstavlja nacionalni mehanizam
prevencije.
Konstatuje se da Srbija nema zakon koji bi regulisao
pitanje tretmana osoba u policijskom pritvoru, da kazne za loše postupanje i
torturu nisu adekvatne niti postoji pravna zaštita od zlostavljanja i torture u
socijalnim institucijama.
Kada je reč o zaštiti ljudskih prava, nadležna državna
tela, skupštinski odbori, ombudsman i organizacije civilnog društva sporvode
aktivnosti na podizanju svesti, tolerancije, suzbijanja diskriminacije i
razvijanju mehanizma za primenu propisa, navodi se u izveštaju o napretku
Srbije na putu ka EU.

The European Commission has estimated that it needs to
reinforce the capacities and resources of the Office of the Commissioner for
Information of Public Importance and the Law in order to improve its

preventive mechanism.

Serbia has no law that would regulate the issue of treatment of persons in

When it comes to human rights protection, the competent
state bodies, parliamentary committees, ombudsman and civil society
organizations are conducting activities to raise awareness, tolerance,
combating discrimination and develop a mechanism for the implementation of
