North Korea: UN expert calls for a people-centred approach
GENEVA / SEOUL / TOKYO (25 November 2016) A United Nations rights expert has appealed to Governments and civil society organizations to put people squarely at the centre of their approaches to improve the human rights situation in the Democratic People’s Republic of Korea (DPRK).
The Special Rapporteur on the situation of human rights in the DPRK, Tomás Ojea Quintana, concluded a 10-day visit to the Republic of Korea and then to Japan – his first trip to North-East Asia after being appointed by the United Nations Human Rights Council in August 2016.
The Special Rapporteur said he had been privileged to hear first-hand from people who had left the country. “I was particularly moved by their testimonies as well as their resilience. Talking to these victims has allowed me to understand some of the human rights violations that motivate their decision to leave,” Mr. Ojea Quintana said. “It was remarkable that these people were well aware of their rights. Despite all the challenges that they have been through, they now look forward to the future.”
“I also met people who have lost trace of close relatives as a result of abductions or displacement during the Korean War. Their suffering is enormous and the urgency for the solution is accelerating with advancing age of victims and their families”, the independent expert told reporters in Tokyo today.
The expert also stressed the need to hold perpetrators of human rights violations
accountable for their actions, which he said had been reflected in his discussions with government agencies in the Republic of Korea and Japan. Pursuing accountability could also deter further violations, he added.
Some civil society groups, the expert noted, were documenting cases and focusing on accountability, while others were trying to expand humanitarian and human rights initiatives by pushing for more engagement with the DPRK authorities.
He said both approaches were complementary and all civil society groups deserved his support.
“I do not see that these two ways – pursuing accountability and seeking engagement - exclude each other,” said Mr. Ojea Quintana. “The situation in the DPRK is extremely complex and requires a multi-faceted approach. People must always remain central to all these efforts.”
The Special Rapporteur will deliver a full report on his mission to the Human Rights Council in March 2017.

Mr. Tomás OJEA QUINTANA (Argentina) was designated as the Special Rapporteur on the situation of human rights in the DPRK by the UN Human Rights Council in 2016. Mr. Ojea Quintana, a lawyer with more than 20 years of experience in human rights, worked for the Inter-American Commission of Human Rights, and represented the Argentinian NGO “Abuelas de Plaza de Mayo” in cases concerning child abduction during the military regime. He is a former Head of OHCHR human rights programme in Bolivia, and served as the UN Special Rapporteur on the situation of human rights in Myanmar from 2008 to 2014. The Special Rapporteurs are part of what is known as the Special Procedures of the Human Rights Council. Special Procedures, the largest body of independent experts in the UN Human Rights system, is the general name of the Council’s independent fact-finding and monitoring mechanisms that address either specific country situations or thematic issues in all parts of the world. Special Procedures’ experts work on a voluntary basis; they are not UN staff and do not receive a salary for their work. They are independent from any government or organization and serve in their individual capacity.

조선민주주의인민공화국: 유엔 인권 전문가 인간 중심 접근 촉구
제네바 / 서울 / 도쿄 (2016년 11월 25일) 유엔 인권 전문가가 관련 정부 및 시민사회단체에 조선민주주의인민공화국 내 인권 상황 개선을 위해 인간 중심으로 접근하도록 촉구했다.
조선민주주의인민공화국 내 상황에 대한 특별보고관 토마스 오헤아 퀸타나는 대한민국와 일본을 방문한 10일 간의 일정을 마무리했다. 지난 8월 유엔 인권이사회에서 신임 특별보고관으로임명된 후 동북아 첫 방문이다.
특별보고관은 감사하게도 탈북자에게 직접 이야기를 들을 수 있었다며 “탈북자 증언 뿐 아니라 그들의 강인함에 깊은 감명을 받았다. 탈북자가 자신이 누려야 할 권리를 잘 인지하고 있어 인상깊었다. 여태까지 상당한 어려움을 겪었음에도 이제는 미래를 꿈꾸고 있다”고 말했다.
“더불어서 납치나 한국전쟁 중 실향으로 친인척 소식을 알 수 없게 된 이들도 만났다. 모두 상당히 괴로워했고, 특히나 피해자와 피해자 가족이 나이가 들어감에 따라 더욱 시급하게 해결해야할 문제가 되었다”라고 오늘 도쿄에서 열린 기자회견에서 특별보고관이 말했다.
또한 인권 침해 가해자에 책임을 물어야 한다고 강조했다. 특별보고관은 대한민국과 일본의 관련 정부 기관과 면담에서 이를 언급했다고 말했다. 책임 규명 노력이 추가적인 인권 침해를 막을수도 있다고 덧붙였다.
특별보고관은 일부 시민사회단체는 인권 침해를 기록하고 책임 규명에 집중하고, 또 일부는 조선민주주의인민공화국 당국과 협력을 확대하여 인도주의 및 인권 계획을 강화하려 한다고 언급했다.
책임 규명과 협력 확대에 각각 초점을 맞추는 두 접근 방법은 상호 보완적이며, 특별보고관으로서 시민사회단체 모두를 지원한다고 말했다.
특별보고관은 “책임 규명과 협력 확대 노력이 상호 배제한다고 보지 않으며, 조선민주주의인민공화국 내 상황이 상당히 복잡한만큼 다각적접근이 필요하다. 또한 항상 인간을 중심에 두고 접근해야 한다”고 강조했다.
특별보고관은 2017년 3월 인권이사회에 금번 동북아 방문 결과를 반영하여 보고서를 제출할 예정이다.

北朝鮮：人々を人権改善活動の中心に
ジュネーブ／ソウル／東京（２０１６年１１月２５日）国連の専門家が、各国政府や市民団体にたいして、朝鮮人民民主主義共和国（DPRK）の人権状況を改善する活動の中心に、人々を据えるよう呼びかけました。
国連北朝鮮人権特別報告者、トーマス オヘア キンタナ氏は、２０１６年８月に指名されてから初めての北東アジアへの訪問を終えました。１０日に渡る訪問中、キンタナ氏は韓国そして日本を訪れました。
特別報告者は脱北者から直接話しを聞く恩恵に恵まれ、彼らの証言、そして力強さには本当に感動させられた、と述べました。「これら人権侵害の犠牲者達と面談することで、どのような侵害が脱北の理由となっているかを理解することができました。また、これらの方々が自分たちの権利について高い認識を持っていることには驚きました。様々な困難をくぐり抜けてきたに関わらず、彼らは前向きに将来をとらえています。」
「私はまた、拉致や朝鮮戦争時の混乱によって近親の行方が全く分からなくなった方々にもお会いしました。彼らの苦しみは計り知れないものであり、犠牲者やご家族が高齢化していることを考えると、問題解決は請求性を要しています」と独立専門家は語りました。
専門家は人権侵害の加害者の責任を糾明する必要も強調しました。責任糾明の必要性は、韓国及び日本の各省庁との話し合いの場でも言及されました。特別報告者は責任糾明を求めることは、さらなる人権侵害を抑止する可能性もあると述べました。
専門家が面談した市民団体のいくつかは人権侵害の情報収集を行い、責任糾明に焦点をあてていました。一方、他の団体にはDPRK政府との連携を求めることによって、国内での人道及び人権活動を活発化させようと努めているものもありました。
どちらのアプローチも正当性があり、特別報告者としては全ての市民団体を支持すると、専門家は述べました。
「この二つの方法 ー 責任糾明を求める一方、連携を求めること ー は必ずしも相反するものではありません。」キンタナ氏は次のように述べました。「北朝鮮の状況は非常に複雑であり、多面性を持ったアプローチが必要とされています。その中でも、人々が中心に据えられなければいけません。」
特別報告者の訪問の結果は、国連人権理事会に２０１７年３月に提出される報告書の中でまとめられる予定です。
